Pathlab – MyWay

Definitions

These terms and conditions (“Terms”) apply to the supply of self-requested medical laboratory tests and reporting of results (“Services”) by Pathology Associates Limited trading as Pathlab (“we”, “us” and “our”). These Terms apply to all Services we provide.  By placing an order for Services the customer (“you”, “your”) agrees to be bound by these Terms.  If there is any conflict between these Terms and any verbal communication between you and us, these Terms will prevail.

 

How to Order

How to order Services from us:

·         Browse our website, myway.pathlab.co.nz, to select the test(s) you require.

·         Complete the form with the required information.

·         Make payment in full through our secure payment gateway. Prices are in New Zealand dollars and include GST.

·         Once your order is confirmed, you will receive a confirmation email with further instructions regarding what you need to do.

·         For collection of the specimen, you need to attend one of our Pathlab collection facilities (as indicated on our location page).

·         At the time of specimen collection, we will verify your identity and age, to do this you must bring proof of identity, such as a passport or driver licence, with you.   

Restrictions

Please note that you must be at least 16 years of age to request Services from us. By placing an order, you confirm that you meet this age requirement.

You cannot order Services on behalf of any other person. Your identity and age will be verified at the time of specimen collection.

Expiry and Refunds

You may cancel your order at any time, unless you have already had a sample taken.

To cancel an order, please send us an email to info@pathlab.co.nz stating that you wish to cancel and your order number.

If you cancel your order within the Validity Period, we will refund the price you paid for the Services to the same credit card you used to make the purchase.

Orders are valid for a period of 12 months from the date of purchase. If you do not attend one of our Pathlab collection facilities for collection of the specimen within this period, the order will expire, and no refund will be provided.

If we cannot process your order or complete the test(s) (except if this is because you do not follow our instructions or you do not follow the correct specimen collection procedures) we will provide you with a refund.

Your Obligations

 You must:

·         Provide accurate and complete information to us.

·         Strictly follow the specimen collection procedures when providing specimens.

·         Provide us informed consent when ordering the Service.

 

Information We Collect

We may also disclose your personal information and test results as set out under the heading “Abnormal Results” below.

We use the Shopify eCommerce platform for billing and payment.  Shopify’s consumer privacy policy can be read at https://www.shopify.com/nz/legal/privacy/app-users
 

Reporting Results

 

You can expect to receive your test results within the timeframe specified on our website for the test(s) that you have ordered.

Once your specimen has been processed, the results of the test(s) will be collated into a report and emailed to your designated email address.  We will not report your results to you via any other method.

As health information is sensitive, we recommend using a personal email address that only you have access to.  We will communicate with you via this email address, including reporting your test results.

Reports delivered to you by email will be encrypted during transmission by industry standard mechanisms.  However, the report will not be an encrypted attachment nor be password protected.  It is your responsibility to ensure the security and confidentiality of the email address you provide to us.

Test Results

All test results are provided for your information only, and we recommend that you provide them to, and discuss them with, a qualified healthcare professional (such as your general practitioner) who can interpret these results and provide you with healthcare advice based on your specific health needs.  It is your responsibility to arrange and obtain this advice. 

We cannot, and will not, interpret the test results for you (regardless of whether the test results are flagged as “abnormal”) or provide healthcare advice as this requires consideration of your specific health needs and is outside the scope of our practice.   

Abnormal Test Results

Laboratory test results are often, but not always, reported against a reference range or with an abnormal flag (High, Low, Abnormal). These reference ranges are determined against a sample of a “normal” New Zealand population. Your test results may or may not be inside the range or may be flagged as abnormal.

It is your responsibility to arrange medical advice if you have any concerns about the values or indications in your test results.  

If your test result is critically abnormal, we may contact emergency services or any other relevant health provider or healthcare professional (which may include your general practitioner) and share with them your test results and your personal information for the purposes of arranging urgent medical care for you.

If a test result is notifiable, we are legally required to notify the Public Health Officer of the result. Further information on notifiable results can be found on the Ministry of Health website at https://www.health.govt.nz/regulation-legislation/notifiable-diseases

Our Obligations

We will:

·         Ensure that all tests are conducted by qualified personnel in accredited laboratories.

·         Comply with all applicable legislation, regulations, and industry standards.

Code of Health and Disability Services Consumers' Rights

We must comply with the Code of Health and Disability Services Consumers' Rights (“Code”). You have rights under the Code, including the right to make a complaint.  The Code can be found at https://www.hdc.org.nz/your-rights/about-the-code/code-of-health-and-disability-services-consumers-rights/

Liability

To the maximum extent permitted by law, and without prejudice to any obligations that we have under applicable law or rights that you have under law (including as a consumer of our Services), our liability is limited to refunding to you the amount that you have paid us for our Services.

New Zealand Law

These Terms are governed by, and will be construed in accordance with, New Zealand law.
